AMWA·AWWA, PFAS

AMWA makes its case in litigation challenging PFAS standards

Lawyers representing AMWA and the American Water Works Association in litigation challenging EPA’s drinking water standards for PFAS were in court last week arguing before a panel of judges that those standards were promulgated unlawfully and should be vacated.

Meanwhile, lawyers representing members of the environmental community intervening in the case told the court that the standards should be upheld. The court is expected to rule on the case by early next year.

During the arguments the judges zeroed in on questions about the construct of the Safe Drinking Water Act, how EPA uses science and available data to move ahead with regulations, and what constitutes adequate opportunities for the public to comment throughout the regulatory process.

AMWA and AWWA filed AWWA et al. vs. EPA in 2024, alleging that several aspects of EPA’s PFAS rulemaking departed from the required processes of the Safe Drinking Water Act.

Specifically, AMWA and AWWA raised concerns about EPA issuing a proposed regulation for those “hazard index” PFAS simultaneously with the agency’s preliminary regulatory determination, and EPA’s use of a novel “hazard index” to regulate the mixture of perfluorohexane sulfonic acid (PFHxS), perfluorononanoic acid (PFNA), hexafluoropropylene oxide dimer acid and its ammonium salt (HFPO-DA, commonly referred to as GenX), and perfluorobutane sulfonic acid (PFBS).

The challenge also raises concerns about an inadequate cost-benefit analysis that failed to fully account for the costs associated with the maximum contaminant level of four parts-per-trillion for PFOA and PFOS.

Following months of written legal filings from parties involved in the case, a three-judge panel from the U.S. Court of Appeals for the District of Columbia Circuit convened last Friday to hear directly from lawyers representing the litigants, and to ask questions about the arguments made in their briefs. Earlier in the week the court had made a change to the previously announced panel, with Judge Gregory Katsas replacing Judge Robert Wilkins.

The panel of judges were particularly animated when questioning legal counsel on the different steps in the regulatory process required by the Safe Drinking Water Act, and what harm was suffered by water systems and the public if EPA did violate requirements to hold separate comment periods on a regulatory determination, and a regulation itself.

An audio recording of the three-plus-hour hearing is available on the Court of Appeals' website, and AMWA and AWWA issued a joint statement following the arguments to reiterate the importance of the legal question at hand.

The court has given no indication of when it may issue a ruling on the case, but the decision could come as late as early 2027. At that point, depending on the outcome, AMWA and other litigants will have an opportunity to decide whether an appeal to the United States Supreme Court is warranted.
