유럽연합 집행위원회(European Commission)는 유럽연합(EU) 물 관련 법률의 준수 여부에 대한 불확실성을 줄여 보다 간소하고 일관된 방식으로 법이 이행될 수 있도록 하는 지침을 지난 5월 22일 발표했다.

이번 지침은 물회복력을 포함한 유럽의 전반적인 회복력 강화 전략을 지원하기 위한 것이다. 유럽연합 집행위원회는 인간의 건강과 환경을 보호하기 위해 높은 수준의 수질 기준을 유지하는 한편, 청정전환에 필요한 핵심원자재에 대한 안정적인 접근을 보장함으로써 유럽의 회복력을 강화한다는 방침이다.

지침은 「물기본지침(Water Framework Directive)」과 이를 보완하는 하위 지침인 「지하수지침(Groundwater Directive)」, 「환경품질기준지침(Environmental Quality Standards Directive)」의 적용 기준을 보다 명확히 제시한다. 이는 EU의 ‘RESourceEU 행동계획(RESourceEU Action Plan)’의 일환으로 마련됐으며, ‘물 회복력 전략(Water Resilience Strategy)’의 목표를 반영했다.

지침서는 신규 사업이 수질에 미치는 환경적 영향을 평가하는 방법을 설명한다. 특히 수역의 화학적 상태에 영향을 미치는 사업을 대상으로 하며, EU 물 관련 법률에 규정된 기준과 해당 법률이 허용하는 환경목표 적용 규정을 설명하고 있다.

아울러 최근 개정된 물 관련 법률을 통해 도입된 새로운 예외 규정에 대해서도 설명한다. 이에 따르면 단기간의 수질 악화만 초래하거나, 전체 오염량 증가 없이 오염원을 다른 위치로 이동시키는 사업의 경우보다 간소화된 절차를 적용할 수 있다. 또한 광산 개발, 금속 가공 및 기타 핵심원자재 관련 사업의 추진을 지원하기 위해 관련 규정의 유연성을 어떻게 활용할 수 있는지에 대한 적용 사례도 제시됐다.

유럽연합 집행위원회는 회원국들과 협력해 핵심원자재 관련 사업의 인허가 과정에서 보다 신속하고 일관된 평가가 이뤄질 수 있도록 지원할 계획이다.

이번 조치는 광업 부문에 초점을 맞추고 있지만, 그 내용은 「재생에너지지침 III(Renewable Energy Directive III)」, 「EU 반도체법(Chips Act)」, 「넷제로산업법(Net Zero Industry Act)」에 따라 육성되는 전략산업 관련 사업과 활동에도 적용될 수 있다. 이는 환경평가 절차의 신속화를 위한 규정 제안을 포함해 인허가 절차를 가속하려는 집행위원회의 노력을 보완하는 역할을 한다.

Commission publishes guidance to strengthen Europe's resilience by clarifying the application of EU water laws

 

The European Commission published today guidance to ensure simpler and more harmonised implementation of EU water laws by reducing uncertainties about compliance.

 It aims to support Europe's overall resilience agenda, which includes water resilience. This guidance is part of the Commission's efforts to support Europe's overall resilience by maintaining high standards for our waters to protect human health and the environment, while ensuring access to the critical raw materials needed for the clean transition.

The guidance provides clarity on the  Water Framework Directive, supported by its so-called daughter directives – the Groundwater Directive and the Environmental Quality Standards Directive. It is part of the RESourceEU Action Plan and takes into account the objectives of the Water Resilience Strategy.

The guidance document explains how to assess the environmental impact of new projects on water quality. It focuses on projects affecting the chemical status of water bodies and rules set out in EU water laws, which already allow for lower environmental objectives.

It also explains new exemptions that are introduced through recent amendments of water legislation. They allow simplified procedures for projects that lead only to short-term deterioration or to the relocation of pollution without a net increase. The document also provides examples of how flexibilities can be applied to facilitate mining, metal processing, and other critical raw materials projects.

The European Commission will work with Member States to ensure that faster and more consistent assessments are carried out for permits relating to critical raw materials projects.

While today's guidance focuses on the mining sector, the conclusions can also be applied to other projects or activities, including those related to strategic sectors promoted under the Renewable Energy Directive III, the Chips Act, or the Net Zero Industry Act. It also complements the Commission efforts to accelerate permitting, including its proposal for a Regulation on speeding-up environmental assessments.
